Terms of service

The agreement between your organisation and Firealert: what the service does, what it can’t do, and what we each agree to.

About these terms

These terms are an agreement between Firealert (Pty) Ltd (“Firealert”, “we”, “us”) and the customer who uses Firealert (“you”). By creating an account or using the service, you agree to them. If you accept them for an organisation, you confirm that you may do so on its behalf.

Our privacy policy and refund policy also apply. If you have a signed agreement with us, it takes priority where it differs from these terms.

The service

Firealert monitors fire alarms in vehicles, such as buses, trucks and machinery, and in buildings. A device reports fire, smoke and panic alarms, temperature, battery, mobile signal and GPS position over the mobile network.

When an alarm comes in, we alert your team by push notification in the mobile app, by email and in the owner web app. If nobody acknowledges, the alert moves up your escalation ladder. Fire, smoke and panic alarms can also be forwarded to the responsible fire department’s station console, with the asset’s live position, owner details, contacts and pre-incident plan.

What Firealert does not do

Firealert detects and reports alarms. It does not put out fires. It does not replace fire suppression systems, extinguishers, an emergency number or the fire service. In an emergency, call the emergency services yourself. From a mobile phone in South Africa you can dial 112.

Firealert depends on mobile networks, GPS and third-party services, such as push notification and email providers. We don’t control them. Signal can drop in tunnels, basements and remote areas, GPS positions can be inaccurate, and devices can lose power or be damaged. So we can’t guarantee that every alarm will be delivered, or delivered within a set time, or that a position will be exact.

Forwarding an alarm to a fire department does not guarantee a response. Each fire department decides how and when to respond.

Accounts

  • Give us accurate details and keep them up to date.
  • Keep sign-in details private. Each person should have their own login.
  • You are responsible for the people you invite to your account and what they do in it.
  • Tell us straight away at hello@firemobile.dev if you think someone has used your account without permission.

Your responsibilities

Firealert only works well if it is set up and looked after. You agree to:

  • keep your contacts and escalation ladder current, so alarms reach people who can act;
  • have every device installed and maintained by an installer we have approved;
  • test each device and your alert chain regularly, and after any change to the vehicle, building or ladder;
  • tell us promptly about faults, damage or devices that stop reporting;
  • tell the people you add as contacts, and your drivers, that Firealert holds their details or tracks the vehicle; and
  • keep meeting your own fire-safety and legal obligations. Firealert adds to them; it does not replace them.

Subscriptions and billing

  • You pay a monthly subscription for each monitored asset, such as a vehicle or a building.
  • Prices are in South African rand (ZAR). They exclude VAT unless we say otherwise, and VAT is added where it applies.
  • Subscriptions are billed monthly in advance and renew each month until you cancel.
  • We will give you at least one month’s notice before we change your price.
  • If a payment is late, we will remind you before we take any action. See “Suspension and termination” below.

You can cancel at any time. Our refund policy explains how cancellation and refunds work.

Hardware

You buy the hardware once. It becomes yours when it is paid for in full. A device only reports to Firealert while its asset has an active subscription. Hardware is covered by your rights under the Consumer Protection Act, and our refund policy explains returns and faulty devices.

Acceptable use

You must not:

  • use Firealert for anything unlawful, or to track people without a lawful reason;
  • trigger false alarms on purpose, or misuse forwarding to a fire department;
  • tamper with devices, or try to break, overload or get around the service’s security;
  • copy, reverse engineer or resell the service without our written permission; or
  • share logins, or let someone use your account in breach of these terms.

Fire department users

Fire departments use Firealert through the station console. Their staff may use the information they see, including positions, owner details, contacts and pre-incident plans, only to plan for and respond to emergencies. They must keep it confidential. Each fire department stays responsible for its own response decisions and for meeting its own legal duties.

Suspension and termination

You can close your account or cancel an asset’s subscription at any time. We may suspend or close an account if payment is overdue, if these terms are seriously breached, or if it is needed to protect the service or other people. Where it is reasonable, we will warn you first and give you time to put things right.

While an account or subscription is suspended or closed, its assets are not monitored and no alarms are sent. We keep or delete your information as our privacy policy describes.

Limitation of liability

We have written this section in plain language because the Consumer Protection Act asks us to draw your attention to terms that limit our liability.

To the extent South African law allows:

  • we are not liable for loss or damage caused by a fire or other emergency itself;
  • we are not liable for alarms that are delayed or not delivered because of mobile networks, GPS, power, third-party services or anything else outside our reasonable control;
  • we are not liable for indirect or consequential loss, such as lost profit or business interruption; and
  • our total liability to you is limited to the fees you paid us in the 12 months before the claim.

Nothing in these terms limits liability that the law does not allow us to limit, such as for gross negligence. Where the Consumer Protection Act applies to you, nothing here takes away your rights under it.

Changes to these terms

We may update these terms as Firealert changes. We’ll post the new version here and change the date at the top. If a change is significant, we’ll tell customers by email before it takes effect.

Governing law

These terms are governed by the laws of South Africa, and the South African courts have jurisdiction over any dispute about them.
